Georgia Source IBC TERMS AND CONdiTIons
1) Collection Program:
Our collection program aims to provide customers with a return service for IBCs after a single use. By participating in this program, you agree to adhere to the terms outlined below.
2) Request Approval:
All collection requests are subject to approval. We reserve the right to reject any request at our discretion.
3) Container Integrity:
Container Integrity: All IBCs must be intact and free of punctures. Damaged containers may not be accepted for collection.
4) Compliance with Regulations:
The containers must meet the following criteria to be considered empty, as per the regulations specified by the Environmental Protection Agency (EPA) and the U.S. Department of Transportation (DOT):
a) EPA's 40 CFR 261.7: A container is considered empty if all waste that can be removed using common practices (such as pouring, pumping, or aspirating) has been removed. Additionally, no more than 2.5 centimeters (one inch) of non-removable residue in the bottom of the container or no more than 3% by weight of the total capacity remains. For specific products listed in 40 CFR 261.31, 261.32, and 261.33(e), the container is empty only if it has been triple rinsed using an appropriate solvent or cleaned using an equivalent method.
b) DOT's 49 CFR 173.29: Containers must be properly emptied, classified, described, packaged, marked, labeled, and in suitable condition for transportation according to applicable DOT regulations. All openings on the empty container must be closed, and all markings and labels must be in place as if the container were full of its original contents.
5) Transportation and Packaging:
Containers must comply with all applicable DOT regulations regarding transportation. This ensures the safety of all parties involved. If required by DOT rules, HAZMAT placards may need to be provided to the driver.
6) Non-Compliance Charges:
Failure to comply with the guidelines outlined above may result in containers being returned freight collect, and all associated charges will be billed to the shipper. In cases where non-hazardous heel (residual chemical) is to be processed and exceeds the empty criteria described above, the chemical residue left in containers will be billed back to the shipper at a rate of $9 per gallon. Please note that one inch of heel is approximately seven gallons. Additionally, a $25 handling fee will apply to each IBC with excess heel, regardless of whether it is returned to the shipper or not.
By utilizing our container management services, you acknowledge and accept these Terms and Conditions. Failure to comply may result in additional charges and other consequences as outlined above.
